Apple rumor site ThinkSecret is no more

We at MacMerc have never been much for rumor publishing. Rumor sites can be fun for their “what if” factor but it’s just not what we do. Oh, and there’s that whole thing about not having any secret sources inside Apple–that part has kind of held us back in that arena.

As it turns out, having secret sources inside Cupertino can not only be the basis for a website, it can also be the reason for taking it down. Nick Ciarelli from Think Secret issued a press release today stating that he and Apple have settled their lawsuit and reached an agreement. Basically, Nick gets to protect his source as long as he shuts down Think Secret and, in exchange, Apple promises not to sue him into the middel of his next life.

Nick Ciarelli cautiously puts it this way “I’m pleased to have reached this amicable settlement, and will now be able to move forward with my college studies and broader journalistic pursuits.”

Yeah, so I think I’m pretty good with not publishing rumors here an MacMerc.

A Class Action lawsuit being prepared against Apple for bricking iPhones

The Law Office of Damian R. Fernandez and The Law Office of M. Van Smith have launched a Class Action suit against Apple and are currently seeking contact with California residents that match any the following criteria:

  • You own an iPhone and you want to transfer to a wireless carrier other than AT&T. You fall into this category even if you did not unlock your iPhone or have your iPhone disabled by an iPhone update.

  • Your iPhone was disabled, malfunctioned, or you had third-party applications erased after you downloaded iPhone update 1.1.1.
  • You contacted Apple to repair your iPhone and Apple refused to honor your warranty because you did any one the following: (1) unlocked your iPhone, or (2) installed a third party application.
  • You incurred a cancellation fee from your previous wireless carrier when you transferred to AT&T’s wireless service.
  • You incurred roaming charges while travelling abroad with your iPhone.
  • You purchased a third-party warranty at extra cost for your iPhone because of Apple’s released statement that it will not honor warranties on unlocked iPhones.

In case you haven’t heard, Eminem’s music publisher filed a multimillion-dollar lawsuit against Apple claiming that copyrights were violated in allowing downloads of the rapper’s songs onto iPods via iTunes.

The sticky points of the suit seem to center around whether labels hold the rights to sell an artist’s music in the form of digital downloads when they acquire the rights to sell the music on CD, or whether the labels need to secure those rights in addition. If that is the real issue, why isn’t Eminem suing his record label?

Eminem’s music publisher “demanded that Apple cease and desist its reproduction and distribution and Apple has refused” Personally, I think Apple should comply with their demands and remove the recorded material from the iTunes Store entirely. If Mr. Mathers thinks his music is being ripped off now while people are buying it on iTunes, he might want to see how well he does when his albums aren’t available on the world’s most popular online music, TV and movie store.
